There are more and more design-build-operate contracts in use in Hong Kong. With the size and extent of projects adopting them growing, the law regulating them are also getting more complicated. In view of these, there is a need to enhance understanding on key legal issues and practices pertaining to the use of such design-build-operate contracts.


This seminar or webinar aims at providing a critical review and update of the legal aspects concerning the common issues in the application of design-build-operate contract in Hong Kong. Through discussion of lessons learnt from decided cases, the law and practice on areas that those involved need to be alerted to are highlighted.


The seminar or webinar will be divided as below:-

  • Design-build-operate contract practice: legal principles, standard forms and personnel
  • Employer's requirements: design input by employer, design development, constraints & restrictions, performance of design work, timing and coordination
  • Contractor's proposals: principles, design at tender stage, approvals design liability and qualifications
  • Conditions of contract, key clauses overview, operation and payment provisions and their interpretation 
  • Professional advisors / services and insurance
  • Situation discussion / case study exercise
