HKIE Standard Fees and Expenses of Adjudication 2022

Objectives

The main objectives in publishing the fee structure are:

  • To provide an indication to potential claimants of the fees chargeable thus hopefully discourage adjudication cases of very trivial amounts.
  • To allow potential adjudicators to have a fair assessment of the maximum fees that they may charge before accepting nominations.
  • To prevent the parties in dispute, especially the respondent, from using disagreement on fees as the reason for not proceeding with the adjudication.

Proposed Fee Structure

The fees and expenses for providing the services under the proposed SOP Provisions in Public Works Contracts (pursuant to SOP Provisions of DEVB TC (Works) No. 6/2021) may comprise:

  • Registration Fee;
  • HKIE’s Administrative Fees;
  • Adjudicator’s Fees; and
  • Other Administrative Expenses (deem necessary).

1.Registration Fee when submitting a Notice of Adjudication

The Claimant would have to pay a non-refundable registration fee of HK$3,000.

2.HKIE’s Administrative Fees

The administrative fees relating to secretarial and accounting services provided by HKIE shall be HK$5,000 for amounts in which the Claimed Amount (as submitted by the Claimant) is less than HK$1,000,000 and for Claimed Amount over HK$1,000,000 (as submitted by the Claimant) shall be HK$10,000.

3.Adjudicator’s Fees

The fees of the adjudicator shall be determined in accordance with the following table:

4.Other Administrative Expenses (deem necessary)

These are out-of-pockets expenses such as travelling, hire charges of venue and equipment, copying, recording, independent expert(s) appointed, etc.
